Terms of Sale (Consumers)

These terms apply to consumers. Business or trade customers: please see our Business Terms of Sale.

These Terms of Sale govern the sale of goods by G E R CONSTRUCTION LTD (company number 08161487, VAT GB 157 695 070), 1 Kings Avenue, London, N21 3NA, to consumers through this website.

Orders and contract formation

You place an order by adding goods to your basket and completing checkout. Your order is an offer to buy. We will acknowledge your order by email, but a binding contract is only formed when we send you an email confirming that your order has been accepted or despatched. If we cannot accept your order — for example because the goods are unavailable or there has been a pricing error — we will tell you and will not charge you, or will refund any payment already taken.

Prices and payment

Prices shown to consumers include VAT.

We accept Visa, Mastercard and American Express (processed securely by Stripe) and, for eligible account customers, Direct Debit through GoCardless. Payment is taken when you place your order. The goods remain our property until we have received payment in full.

We aim to deliver within the timescales shown at checkout. Unless we agree otherwise, we will deliver without undue delay and in any event within 30 days of the day the contract is formed. The goods become your responsibility (risk passes to you) when they are delivered to the address you gave us, or when you or your carrier collect them.

Your right to cancel (14-day cooling-off)

Under the Consumer Contracts Regulations 2013 you may cancel your order for any reason within 14 days of the day you receive your goods. To cancel, tell us within that period — by phone on 01708 868932 or by email at [email protected], quoting your order number. A clear statement that you wish to cancel is enough; you do not have to give a reason.

Once you have told us, you have a further 14 days to return the goods. We refund the price you paid, including standard outbound delivery, within 14 days of receiving the goods back (or of your proof that you have sent them). You are responsible for the cost of returning the goods, and we may reduce your refund to reflect any loss in value caused by handling the goods beyond what is necessary to establish their nature, characteristics and condition.

This 14-day cancellation right does not apply to goods made to your specification or cut to measure. No restocking charge applies to cancellations made under this right.

Returns outside the cancellation period

As a goodwill measure we may also accept change-of-mind returns requested within 30 days of delivery, provided the goods are unused, in their original packaging and in a re-sellable condition. A 15% restocking charge applies to these discretionary returns and you are responsible for return carriage. This is in addition to — and does not affect — your statutory rights. Faulty goods — your statutory rights

Your legal rights under the Consumer Rights Act 2015 are not affected (30-day right to reject, repair or replacement, etc.). To report a fault, contact us on 01708 868932 or [email protected] with your order number and details of the problem. Where goods are faulty or were supplied incorrectly we cover return carriage and no restocking charge applies. Please also tell us as soon as possible — and within 3 working days of delivery — about any shortages or visible damage, and within 7 days if your order does not arrive; prompt notice helps us put things right and does not affect your statutory rights. Our liability to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach, but we are not responsible for loss or damage that is not foreseeable. We do not exclude or limit our liability where it would be unlawful to do so — this includes liability for death or personal injury caused by our negligence, for fraud, and for your legal rights in relation to faulty or misdescribed goods. We supply goods for domestic and private use; if you use them for any commercial purpose we have no liability to you for business losses.

If we cannot resolve it, you can get free, independent advice from Citizens Advice (citizensadvice.org.uk). We do not currently take part in an alternative dispute resolution (ADR) scheme.

These terms are governed by the law of England and Wales; as a consumer you keep the protection of the mandatory laws of your home nation.
